Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the oEdu.ai website, apps and services (the "Service"). The Service is operated by Comzone Inc., a company based in Ontario, Canada ("oEdu.ai", "we", "us"). By creating an account, making a purchase or using the Service, you agree to these Terms and to our Privacy Policy and Cookie Policy. If you don't agree, don't use the Service.

Key points

• You must be 13 or older. Under 18, a parent or guardian must agree to these Terms for you.
• Your account and paid access are for you only. Don't share them.
• Subscriptions renew automatically until you cancel. You can cancel at any time.
• You can get a refund within 7 days of any payment if you haven't accessed any paid content.
• Focus subscribers who meet the study requirements and fail the real exam can claim the pass guarantee.
• Our content is for your personal exam preparation only. Copying, sharing or reselling it isn't allowed.

1. Who can use oEdu.ai

• You must be at least 13 years old to use the Service. Children under 13 may not create an account.
• If you are under 18, or under the age of majority where you live, a parent or legal guardian must review and accept these Terms and our Privacy Policy on your behalf. They are responsible for activity on your account.

2. Your account

• Give accurate, complete information when you sign up, and keep it up to date.
• Keep your password confidential. You're responsible for all activity under your account.
• Accounts are personal. Don't share your login or let anyone else use your paid access.
• Tell us right away at team@oedu.ai if you think someone has accessed your account without permission.

3. Plans

• Current prices are shown on our Pricing page and at checkout before you pay. We may change prices for future billing periods. We'll tell you before a price change affects your subscription.
• Renewal: subscriptions renew automatically at the end of each billing period, at the price shown to you, until you cancel.
• Cancellation: you can cancel at any time from your account. Cancelling stops future charges, and you keep access until the end of the period you've paid for. On the Focus plan, the first 3 months are paid up front, so cancelling during that time takes effect at the end of the 3 months.

4. Payments

Payments are processed by our third-party payment provider. We don't store your full card details. By paying, you confirm you're authorized to use the payment method, and you authorize us and our payment provider to charge it for your plan and each renewal, including applicable taxes. Receipts are emailed to you, and your billing history is in your account.

We may decline or cancel an order, for example because of a pricing or description error, or if we suspect fraud or unauthorized activity. If we cancel an order you've paid for, we'll refund it.

5. Refunds

7-day refund: you can request a full refund of any payment (a first payment or a renewal, on any plan) within 7 days of the payment date, as long as you haven't accessed any paid portion of the course or courses since that payment. Free content doesn't count as paid access.

To request a refund, email team@oedu.ai from your account email with your name and the payment date. Approved refunds go back to your original payment method. If a refund is approved, the paid access for that payment ends.

We can't offer a refund when:

• the request is made more than 7 days after the payment
• you've accessed paid content since the payment
• your account was suspended for breaking these Terms

We don't offer partial refunds for unused time in a billing period, except where the law requires it. If you think you were charged in error, contact us promptly and we'll review it.

Customers in the EU and UK: you have a legal right to withdraw from a digital purchase within 14 days. When you start accessing paid content, you ask us to begin providing it right away and you acknowledge that you lose that withdrawal right once you do. If you haven't accessed paid content, you can still withdraw within 14 days of the payment for a full refund.

6. Pass guarantee

Pass guarantee: fail the real exam and get 3 additional months free on request, with evidence of the attempt.

The pass guarantee applies to Focus plans only. Unlimited subscriptions (quarterly and yearly), free accounts, and access we grant manually or at no charge do not qualify.

Who qualifies

You can claim the pass guarantee for a course when all of the following are true:

1. You had at least 90 days of paid access on the Focus plan to that course. The days don't have to be consecutive.
2. You answered every practice question in the course at least once.
3. You submitted at least 2 Exam Simulator attempts in the course, with an average score of 80% or higher across your submitted attempts.
4. You took the official exam and did not pass, and you have official proof of the failing result, such as the score report from the exam provider.
5. You send your claim within 30 days of your exam date.

What you get

3 months of free access to the same course or to another exam course of your choice, added to your account once your claim is approved.

How to claim

Email your official score report to team@oedu.ai from your account email, with the course name, your exam date, and whether you want the 3 free months on the same course or on another course (tell us which). You can hide details we don't need, such as your candidate ID. Claims are handled by email only. You can't upload files to the site.

We check your claim against your account records (paid access days, practice completion and Exam Simulator results) and reply by email.

Limits

• One approved claim per student per course.
• The reward is free access only. There are no cash refunds, it has no cash value, and it can't be transferred.
• The pass guarantee doesn't promise that you will pass any exam.
• We may decline claims that don't meet these requirements or that include altered or unverifiable documents.

7. Acceptable use and honor code

When you use the Service, you agree not to:

• copy, scrape, download in bulk, resell, publish or share course content, questions, answers or explanations outside the Service
• share your account or paid access with others
• use bots, scrapers or other automated tools to access the Service or collect data from it
• post content that is unlawful, abusive, misleading, or that infringes anyone's rights
• post, request or share questions from live exams, or anything that breaks an exam body's confidentiality rules
• interfere with the Service, or test its security without our written permission
• use the Service to build a competing product, or to train machine-learning models

We may remove content, and suspend or close accounts, that break these rules.

8. Intellectual property

All course content (lessons, questions, explanations, flashcards, practice exams, software, design, and the oEdu.ai name and branding) belongs to oEdu.ai or our licensors and is protected by copyright, trademark and other laws. While your access is active, we grant you a personal, non-exclusive, non-transferable license to use the content for your own exam preparation. You may not reproduce, sell or commercially use any part of it without our written permission.

Exam and certification names are trademarks of their respective owners. oEdu.ai is not affiliated with, endorsed by or sponsored by any certification body or exam provider.

9. Content you post

If you post comments, discussion replies, votes, notes visible to others, or feedback, you keep ownership of it. You give us a worldwide, royalty-free license to host, display, adapt and use it to operate and improve the Service. You're responsible for what you post. We may remove content that breaks these Terms.

10. Copyright complaints

We respect intellectual property rights. If you believe content on oEdu.ai infringes your copyright, email team@oedu.ai with the subject line "Copyright Notice" and include:

• a description of the copyrighted work
• the exact URL of the material you believe infringes it
• your name, mailing address, phone number and email address
• a statement that you believe in good faith the use isn't authorized by the copyright owner, its agent or the law
• a statement that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner
• your physical or electronic signature

We'll review every notice and remove or disable access to infringing material where appropriate. Knowingly false claims may lead to liability for damages.

11. The AI tutor

The AI tutor is a study aid that supports, but doesn't replace, your own study, the course lessons and official exam materials.

• Its explanations are generated automatically and may sometimes be incomplete, out of date or wrong. Check important points against the course and the exam body's official materials.
• It doesn't provide legal, medical, financial or other professional advice.
• Fair-use limits may apply, and we may update, limit or change AI tutor features at any time.

12. Promotions

We may run promotions, discounts or giveaways with their own rules. If a promotion's rules conflict with these Terms, the promotion rules apply for that promotion.

13. Exam information and results

We work hard to keep content and exam information accurate and current, but exam bodies set and change their exams, and results depend on many factors. Except for the pass guarantee in section 6, we don't guarantee any exam result. oEdu.ai courses don't award certifications or academic credit. Always confirm exam details, such as cost, format and eligibility, with the exam body before you book.

14. Changes to the Service and these Terms

We may update or discontinue parts of the Service, including courses for exams that are retired. We may also update these Terms. If we make a significant change, we'll give you at least 30 days' notice by email or in the Service before it takes effect. If you keep using the Service after the change takes effect, you accept the updated Terms. If you don't agree, stop using the Service and cancel your subscription.

15. Suspension and closing your account

You can stop using the Service and ask us to close your account at any time. We may suspend or close your account, without refund, if you break these Terms or engage in fraudulent or unauthorized activity. Sections that by their nature should continue (including intellectual property, disclaimers, limitation of liability, indemnification and governing law) survive after your account ends.

16. Disclaimers

The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Service will be uninterrupted, secure, error-free or free of harmful components, or that it will meet your expectations.

17. Limitation of liability

To the extent permitted by law, oEdu.ai and its directors, employees, partners and suppliers are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or opportunities, arising from your use of, or inability to use, the Service. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that can't be limited by law, or your statutory rights as a consumer.

18. Indemnification

You agree to indemnify and hold harmless oEdu.ai and its directors, employees and agents from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your infringement of anyone's rights.

19. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have jurisdiction over any dispute. If you're a consumer in the EU, the UK or another country whose laws give you the right to bring a claim in your local courts or under local consumer law, nothing in these Terms takes that right away.

20. General

• If any part of these Terms is found unenforceable, the rest stays in effect.
• If we don't enforce a provision right away, we don't waive our right to enforce it later.
• You may not transfer your rights under these Terms. We may transfer ours as part of a reorganization, merger or sale of our business.
• These Terms, together with the policies they reference, are the entire agreement between you and us about the Service.
